Conditions of Entry

By entering Mitre 10 Park, you agree to follow our conditions of entry, that are in place to ensure the safety, well-being, and enjoyment of all visitors.

  • Keep it friendly and respectful - Positive Vibes Only!

  • Mitre 10 Park is a smoke-free, vape-free, and drug-free environment

  • Help keep our park clean - please use the rubbish bins provided to dispose of your waste

  • Please use the designated car parks and avoid parking on the grass, unless directed to by officials

  • Vandalism or defacing any property, including tagging is strictly prohibited

  • Alcohol is strictly prohibited

  • Physical violence, threats of violence, abusive language and aggressive behaviour is strictly prohibited

  • Bandanas, patches or any other display of gang affiliation are not permitted

  • No weapons are allowed on the premises

  • All dogs must be kept on a leash at all times

  • If you’re planning to bring a large group (10+ people) or you're running structured or commercial sessions you must book in advance and pay the required hire fees. This includes 1 on 1 training sessions in a professional capacity.

  • Use of Mitre 10 Park facilities for any commercial activity without payment is not permitted

Liability

Mitre 10 Park does not accept responsibility for any personal injury, loss of property, or any other harm, except for that caused by negligence or wilful misconduct of Mitre 10 Park or its employees.

Breach of conditions

Cameras are operating and footage will be used to review any incidents and support any disciplinary or legal proceedings as required.

Any breach of these conditions of entry may result in a trespass notice being issued under the Trespass Act 1980.

Venue hire terms

Rubbish & Packdown - All rubbish generated by the hirer or the hirer’s supporters is to be placed into the bins provided. The cost to clear/clean left rubbish will be charged to the hirer. All facilities must be packed up by the agreed date and time or an additional day’s venue hire may apply. 

Sports Surface and Quality - The hirer shall take all necessary steps to ensure the sports grounds are not unduly damaged through inappropriate use by the hirer. “Inappropriate use” includes use of the grounds when they have been closed because of bad weather. The Athletics Infield is not to be used for training. Mats must be used to access the grass area within the track if people are wearing sprigged boots. Vehicles and bikes must not be driven on the Athletics Track, Turf, Courts or Fields without written consent from Mitre 10 Park. Weights must not be placed on the Athletics track.

Ground penetrations - It is the responsibility of the event organiser to ensure that prior to any ground penetration (e.g. tent pegs, hangi, activities during the event or pack-in or pack-out that may penetrate the ground) that underground services such as electrical cables, gas lines or water pipes have been properly located. You must obtain written consent from the Mitre 10 Park management team before performing these operations.

Equipment - Any equipment used by the hirer is the sole responsibility of the hirer.  Set-up and pack down are the hirer’s responsibility. It is expected that the hirer will test all equipment prior to the event and report any malfunction to the Mitre10 Park Management. Temporary structures such as tents, marquees, stages and stalls may require a building consent if over 100sqm. It is the responsibility of the event organiser to ensure that the relevant consents have been obtained and that they also have permission from the Mitre 10 Park management team.

Security and Damage - All buildings are to be kept secured and tidy at all times during the period of usage with any items of repair required to be reported immediately. On-site security is the responsibility of the hirer. A $1,000.00 bond against damage may be required.  The bond is to be lodged with Mitre10 Park Hawke’s Bay no later than a week prior to the event.  The bond will be returned only after staff have inspected the site and found it to be free of any damage. No fires are permitted.

Keys - Any keys required will be issued to the nominated key holder at the commencement of the event.  A key deposit of $50 is required, which will be refunded at the end of the hire period when the key is returned to the Booking Officer. Under no circumstances should keys be given to other persons for their use of the grounds/facilities.  Sub-letting of grounds to any other user group is not permitted.

Catering - All sales of merchandise, food and beverages are to be approved by Mitre10 Park Management, unless alternative arrangements have been made. A comission may apply. Alcohol is not permitted on site without prior arrangement.

Insurance and damages - The hirer shall be responsible for the cost of any damage sustained to the venue during the period of hire.  Public Liability Insurance to the value of $5 million NZD and any insurance on property or equipment which does not belong to the Mitre10 Park is the responsibility of the hirer.

Traffic management - Traffic management is the responsibility of the hirer. Mitre 10 Park can provide assistance where required. A fee will apply for this service.

Emergency Evacuation - The hirer must ensure that no entrances or exits are blocked by persons, furniture or equipment at any time. It is the hirer’s responsibility to ensure that public are aware of evacuation requirements and that key people are briefed with this responsibility. 

Deposit and cancellations - All hire cancellations must be notified in writing. Cancellations are subject to the following charges and will be invoiced accordingly, at the discretion of Mitre 10 Park Management:

  • 30 days’ notice                          No charge – any deposit paid will be refunded in full.

  • 14-29 days’ notice                    50% of the total hire fee will be invoiced.

  • Less than 14 days’ notice        100% of the total hire fee will be invoiced

 Mitre10 Park management reserves the right to cancel or amend bookings. Any changes will be notified at least 10 working days in advance.

Health & Safety - Any person/s or group hiring/using facilities within the Mitre 10 Park will be required to have a Risk Assessment and Management (RAM) plan or similar, to satisfy overlapping duties under the Health and Safety at Work Act 2015.  The RAM or similar will need to be submitted to the Mitre10 Park management team at least 2 weeks prior to the event date.

 The RAM or similar will need to include (but not limited to)

  • Risk assessment and appropriate control measure

  • Traffic management

  • Public management and security

  • Emergency management

Mitre 10 Park management are to be notified of any incident requiring a callout from Emergency services. Any significant incidents such as aggressive behaviour must also be reported to Mitre 10 Park management.

It is expected that all equipment brought/used onsite is safe and fit for purpose.  Equipment requiring certification/inspection under a NZ regulation or safety standard must have current certification/inspection.

For events that include special effects (such as lasers and fireworks), it is the event organisers responsibility to meet all the relevant requirements for the use of special effects in consultation with WorkSafe NZ. The event organiser is the person in charge for the purposes of the HSNO Act 1996 (Hazardous Substances and New Organisms Act) and its regulations. Use of fireworks require written consent from Mitre 10 Park.

Mitre 10 Park is within 4km of an Aerodrome. This means the use of drones and unmanned aerial vehicles (UAV’s) is not allowed unless permission is obtained from the Mitre 10 Park management team and the requirements of local council, and the Civil Aviation Authority (CAA) have been met.

Please inform the Mitre 10 Park management team of any risk, that may impact on any other park user.
